New Ontario rules aim to improve job access for newcomers, i.e., newcomers searching for work in Ontario may soon find it easier to get interviews and jobs that match their skills. Starting January 1, 2026, the province will bring in several new rules for publicly posted job ads under changes to Ontario’s Employment Standards Act (ESA).

One of the biggest changes is a ban on asking for “Canadian work experience” in job postings or on job application forms. For years, many skilled newcomers have said this requirement unfairly blocks them from getting jobs, even when they have strong international experience.

At the moment, employers can still ask for Canadian experience, even when foreign experience is equal. Critics say this stops qualified newcomers from competing fairly in Ontario’s job market.

The new rule will apply to employers who have 25 or more workers at the time they post a job.

Several more changes are also coming in 2026 to make job applications more open and fair for all job seekers, including newcomers.

Salary Information Must Be Shown

Employers will need to show the expected pay or salary range in any public job posting.

Under this rule, every publicly listed job must include a clear pay amount or a pay range. If the employer uses a range, it cannot be more than $50,000 from the lowest to the highest number.

However, this requirement does not apply to jobs that pay more than $200,000 a year, or if the top number in the range is above $200,000 a year.

Employers Must Reveal If They Use AI

If an employer uses AI in any part of the hiring process, the job posting must clearly mention it. This will help newcomers understand how their applications may be screened, and they can better prepare their resumes and answers for automated systems.

Postings Must State If The Job Is Real

All public job postings must now say whether the job is an actual, open position.

This change is meant to stop employers from posting “fake” jobs for future hiring needs or general labor market testing. These kinds of postings can confuse job seekers and waste their time.

Interviewed Applicants Must Get Updates

If an employer interviews someone, they must update the applicant on the hiring decision. This notice must be given within 45 days of the interview (or final interview, if there are several). Employers can share the update in person, by writing, or through digital communication.

Together, these updates are designed to make hiring more open, honest, and fair. Newcomers, in particular, may get a better chance of getting jobs that match their skills, training, and experience.
